1. General Information

This Privacy Policy applies to the online platform annoncio.eu ("Website") and the associated application ("Application") (the Website and the Application are collectively referred to as the "Platform") intended for users located in France.
The data controller of your personal data is Annoncio, located in Lille, France. In this document, the terms "We" and "Annoncio" refer to the company Annoncio. You will find more details on how to contact us at the end of this Privacy Policy, in section 7.
We take the protection of your data very seriously. All personal data is collected, stored, and used by us in accordance with the General Data Protection Regulation of the European Union No. 2016/679 ("GDPR") and other applicable regulations.
The services we offer through the Website and/or the Application can only function if we collect, store, transfer, delete, and/or use ("collect and use") certain data about you ("personal data" or "data"). Personal data refers to any information relating to an identified or identifiable person, such as your name, date of birth, address, or email address.
This Privacy Policy describes the type of data we collect, the purposes of this collection, and how we use the data when you use the services offered on our Platform. It also contains important information about the protection of your data and the legal rights you have in this regard.
Certain features of our Platform are provided by third-party providers. When you use these services, the data protection regulations of these third-party providers will also apply in addition to this Privacy Policy. Before using these services, third-party providers may ask you to grant permission under data protection laws.
Subject to applicable laws, Annoncio may process the data necessary for the performance of a contract with you or for pre-contractual measures (Art. 6 (1) (b) of the GDPR). By using the Platform and our services, you enter into a legally binding contract with Annoncio, as described in the Terms of Use (ToU).

2. Why and how do we collect and use your personal data?

2.1. To enable you to use the Platform, access our services, and comply with our ToU

We collect and use your personal data to enable the use of the Platform, provide our services, and fulfill a contract (ToU) with you, including performing commercial transactions via the Platform, using the electronic payment system, or leaving reviews and communicating with other members. To access these services, you must create an Annoncio account.
Most of your personal data is necessary to fulfill a contract (ToU) with you. If you do not provide us with this data, we will not be able to conclude or perform this contract with you. Some of your data is also required to comply with our legal obligations when you register on our Platform.
We collect and use your data for these purposes until your account is deactivated or inactive for a period of five (5) years.

2.1.1. To enable registration on the Platform

When you register as a member of the Platform, you must provide the following data to complete your registration and access your Annoncio account:

  • Username;
  • Full name;
  • Email address;
  • Postal code;
  • Confirmation of your age (18 years or older);
  • Password.

We also determine your location based on your IP address at the time of registration. You can, at any time, choose to change your city and make it invisible to other members in your Annoncio account settings.
We collect and use your personal data for this purpose until your account is deactivated or inactive for a period of five (5) years.

2.1.2. To authenticate your identity via Google, Facebook, or Apple

If you register using your Google, Facebook, or Apple account, you will be redirected to the corresponding site to enter your login information. The following information may be shared with Annoncio depending on the provider:

  • Profile picture;
  • Full name;
  • Account ID;
  • Email address.

You can unlink your Google, Facebook, or Apple account from your Annoncio account at any time.

2.1.3. To set up your user profile

If you choose to add details to your profile, we collect and use the following data when you decide to provide it:

  • Full name;
  • Gender;
  • Date of birth;
  • Profile picture;
  • Photo metadata (geolocation, device ID, date, and time).

Only your profile picture and certain information will be visible to other users of the Platform.

2.2. To enhance your experience using the Platform

We collect and use your personal data to enhance your experience using the Platform by allowing you to customize your news feed and search results, providing you with relevant suggestions, saving your previous searches, sending you notifications, and making the use of the Platform more enjoyable.
The specific legal bases for collecting and using your data are described in each section below.

2.2.1. To configure your preferences regarding your news feed and search results

If you choose to customize the articles presented to you on the Platform (in the news feed, catalog, and search results), we collect and use the following data to provide you with a personalized news feed based on your preferences:

  • Interest in articles for women, men, or children;
  • Preferred sizes of articles;
  • Preferred brands of articles.

The legal basis for this collection and use of your personal data is our legitimate interest, as well as that of our members (Art. 6 (1) (f) of the GDPR), to make the Platform more user-friendly and allow members to see offers that may interest them the most.
We collect and use your personal data for this purpose until your account is deactivated or inactive for five (5) years.

2.2.2. To personalize your news feed and search results

We also personalize article feeds based on your preferences, taking into account the following:

  • Gender;
  • Age;
  • Country;
  • Language;
  • Information about your browsing activity on the Platform;
  • Purchase history;
  • Your preferences.

The legal basis for this collection and use of your personal data is our legitimate interest, as well as that of our members (Art. 6 (1) (f) of the GDPR), to make the Platform more user-friendly and allow members to see offers that may interest them.
We collect and use your personal data for this purpose as long as your account is active.

2.2.3. To highlight valuable items sold by reputable sellers

To determine whether you, as a reputable seller, offer valuable items, we collect and use the following data when you sell items on the Platform:

  • Number of positive reviews;
  • Information indicating whether the seller offers items at 60% lower prices than similar items sold on the Platform (similarity being determined by item category, brand, and condition).

We use this information to prioritize valuable items sold by reputable sellers when displaying items to new members and to increase the visibility of items posted by members who speak the same language as you, live in the same country or region, have three (3) or more favorites, or items for children that have one or more favorites, as well as items featured through paid services.
The legal basis for this collection and use of your personal data is our legitimate interest in prioritizing valuable items sold by reputable sellers to facilitate sales and member satisfaction on the Platform (Art. 6 (1) (f) of the GDPR).
We collect and use your personal data for this purpose until your account is deactivated or inactive for five (5) years.

2.2.4. To recommend relevant items

If you choose to create item listings on the Platform, we collect and analyze the data you provide in the listing to suggest other relevant items to members who have clicked on your items or to present them to potentially interested members.
The legal basis for this collection and use of your personal data is our legitimate interest in improving the Platform to offer relevant suggestions and search results (Art. 6 (1) (f) of the GDPR).
We collect and use your personal data for this purpose until your account is deactivated or inactive for five (5) years.

2.2.5. To suggest relevant item descriptions

When you create item listings on the Platform, we collect and analyze the data you provide to suggest the most appropriate description for your listing.
The legal basis for this collection and use of your personal data is our legitimate interest in improving the Platform to offer relevant suggestions (Art. 6 (1) (f) of the GDPR).
We collect and use your personal data for this purpose until your account is deactivated or after five (5) years of inactivity.

2.3. To ensure the security of your account and the Platform

Annoncio strives to ensure that our members' accounts and the Platform itself are secure and protected against cyberattacks, unauthorized access, and other similar risks.

2.3.1. Monitoring visits to the Platform for security purposes

When you visit, register, or log into our website or application, we collect and use the following data:

  • Username
  • Visitor or user ID
  • Email address
  • IP address of your device
  • Browser used by your device
  • Content and URLs accessed
  • Session information

If you access the Platform via mobile devices, the following log files are also collected during your use of the Annoncio application:

  • Model and manufacturer of your mobile device
  • Operating system used by your mobile device (iOS, Android, etc.)

This data is used for security purposes, including preventing cyberattacks such as data scraping, denial of service attacks, and distributed denial of service attacks, as well as preventing unauthorized applications or extensions that could be used for malicious purposes.

The legal basis for this collection and use is our legitimate interest in protecting the Platform and ensuring its security, as well as the legitimate interest of our members in ensuring the security of their accounts on the Platform (Art. 6 (1) (f) of the GDPR).

The personal data collected and used for this purpose is retained for 3 months.

2.3.2. Preventing the use of a compromised password

If you choose to register with a password or decide later to change it, we will check it against a database of compromised passwords from previous data breaches on other platforms and services. To enable this feature, we hash the password and use the first 5 characters of the hash to search Have I Been Pwned (https://haveibeenpwned.com/) for compromised passwords.

This verification helps us protect your account by confirming that you are using a password that is not known to be compromised.

The legal basis for this collection and use is our legitimate interest in protecting the Platform and ensuring its security, as well as the legitimate interest of our members in ensuring the security of their accounts on the Platform (Art. 6 (1) (f) of the GDPR).

We collect and use personal data for this purpose only for the time necessary to perform the password verification.

2.3.3. Resetting your password

If you forget your password or decide to change it for other reasons and do not have access to your email, we may ask you to answer a few security questions to verify your identity. For this purpose, we collect and use the following data:

  • Email address
  • Date of birth
  • Registration date
  • Information about the last transaction

The legal basis for this collection and use of your personal data is our legitimate interest in protecting the Platform and ensuring its security, as well as the legitimate interest of our members in ensuring the security of their accounts on the Platform (Art. 6 (1) (f) of the GDPR).

We collect and use your personal data for this purpose until your Annoncio account is disabled or inactive for five (5) years.

2.3.4. Verifying your account in case of suspicious activity

If we detect activity on your account considered suspicious by Annoncio, we will ask you to perform a basic verification by confirming your email address and your Facebook or Google accounts. To perform this basic verification, we collect and use the following data:

  • Email address
  • Information received during authentication via Facebook or Google (as described in 2.1.2 above)

The legal basis for this collection and use is our legitimate interest in protecting the Platform and ensuring its security, as well as the legitimate interest of our members in ensuring the security of their accounts on the Platform (Art. 6 (1) (f) of the GDPR).

We collect and use your personal data for this purpose until your Annoncio account is disabled or inactive for five (5) years.

2.3.5. Phone and two-step verification

If you choose to add a layer of protection to your account and activate phone verification, we will use your phone number to enable this function. The legal basis for this collection and use is our legitimate interest in providing our users with additional measures to protect their accounts (Art. 6 (1) (f) of the GDPR).

You may also be required to verify your phone number in case of suspicious activities on your account. In this case, the verification is mandatory, and the collection and use of personal data is based on the execution of a contract (CGU) to which you are a party (Art. 6 (1) (b) of the GDPR).

When you verify your phone number, Annoncio will collect and use your phone number for verification purposes.

The personal data for mandatory verifications is necessary to enter into and perform a contract (CGU) with you. If you do not provide us with this personal data, we will not be able to enter into and execute a contract (CGU) with you.

To perform phone and two-step verifications, we use the service provider Vonage Holdings Corp. (USA), which allows us to send you verification messages or make verification calls to dictate a verification code if you do not verify your phone number within 5 minutes. Although this involves sharing your data outside the European Economic Area, the data is protected by the service provider who enters into EU Standard Contractual Clauses for approved data transfers by the European Commission.

We collect and use your personal data for this purpose until your Annoncio account is disabled or inactive for five (5) years.

2.3.6. Security checks of the payment source

As part of the security process, we require our members to provide verification of their payment source. To perform these security checks, Annoncio collects and uses the following personal data:

  • Username

When we perform a payment card security check: information contained in a photo of the payment card: full name, expiration date of the card, and the last four digits of the card number, other information visible on the front of the card if the member chooses not to mask it.

When we perform a bank account security check: information contained in a photo/screenshot of the bank statement listing the last charges: date and description of the last Annoncio charge, other payment information if the member chooses not to mask other information.

The legal basis for this collection and use is our legitimate interest in protecting the Platform and ensuring its security, as well as the legitimate interest of our members in ensuring the security of their accounts on the Platform (Art. 6 (1) (f) of the GDPR).

The personal data collected and used for this purpose is retained for 4 days after the security check has been completed.

2.3.7. Security checks of PayPal accounts

As part of the security process, we require our members to verify the ownership of their PayPal accounts when there has been no actual charge. In this process, Annoncio collects and uses the following data:

  • Username
  • Registration email address
  • Information in screenshots of the PayPal profile: full name of the account holder, address, and other visible data.

As part of the security process, we also ask our members using PayPal to verify the ownership of their PayPal accounts. In this context, Annoncio collects and uses the following data:

  • Username
  • Registration email address
  • Information in screenshots of the detailed version of the most recent Annoncio order account statement: date, amount, full name of the account holder, shipping address, and other visible data.

The legal basis for this collection and use is our legitimate interest in protecting the Platform and ensuring its security, as well as the legitimate interest of our members in ensuring the security of their accounts on the Platform (Art. 6 (1) (f) of the GDPR).

The personal data collected and used for this purpose is retained for 4 days.

2.5. To facilitate your payment for items

Payments made on the Annoncio platform are processed via payment service providers that offer payment processing and escrow services.

Most of your personal data is necessary to execute a contract (CGU) with you. If you do not provide us with this personal data, we will not be able to conclude or execute a contract (CGU) with you (Art. 6 (1) (b) of the GDPR). Some of your data is required to comply with our legal obligations or those of our payment service providers when you are a member of our platform (Art. 6 (1) (c) of the GDPR). If you do not provide us with this personal data, we or our payment service providers will not be able to comply with legal requirements or provide our services.

This data is also used to improve the platform to offer a better experience to our members.

2.5.1. To allow you to make a purchase or add a payment card

When you add a payment card or purchase an item or our additional services through the platform, we collect and use the following data to enable you to make payments:

  • Full name;
  • The first six and last four digits of your payment card number;
  • Expiration date.

When you add a payment card or purchase an item or our additional services through the platform, the relevant payment service provider receives the following data:

  • Full name of the cardholder;
  • Payment card number;
  • Expiration date;
  • Security code (CVV/CVC).

The legal basis for collecting and using this data is the performance of a contract (compliance with our Terms of Service) to which you are a party (Art. 6 (1) (b) of the GDPR). Personal data is necessary to execute a contract (Terms of Service) with you. If you do not provide us with this personal data, we will not be able to enter into or perform a contract (Terms of Service) with you. If you wish, we will keep your card information for future use. The legal basis for this collection and use is your consent (Art. 6 (1) (a) of the GDPR). We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

2.5.2. To allow you to add a bank account for withdrawals

When you add a bank account for withdrawals, we collect and use the following data to enable you to withdraw money:

  • Full name of the account holder;
  • Account number;
  • Address.

The legal basis for collecting and using this data is the performance of a contract (compliance with our Terms of Service) to which you are a party (Art. 6 (1) (b) of the GDPR). Personal data is necessary to execute a contract (Terms of Service) with you. If you do not provide us with this personal data, we will not be able to enter into or perform a contract (Terms of Service) with you. We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

2.5.3. To allow you to pay and receive payments on our platform

If you choose to pay a seller or for additional services by credit card or another integrated payment method on the platform, the transaction will be processed via the electronic payment system ADYEN (see our Terms of Service), managed by ADYEN N.V. (Netherlands) ("ADYEN"). On behalf of Annoncio, ADYEN will collect payment information based on the selected payment method (e.g., credit card, etc.). The payment will then be made via ADYEN and the owner or facilitators of the payment scheme you selected. In this regard, the data protection rules of ADYEN and those of the owner or facilitator of the payment scheme you selected will apply. For more information on the payment process, please refer to Article 6 of our Terms of Service. If you use a credit card as a payment method, Annoncio will only see the full name of the cardholder, the first six and last four digits of your card number, and the expiration date. This information will be used solely to confirm the payment. The rest of the card data is masked and sent to ADYEN to process the transaction. The legal basis for collecting and using this data is the performance of a contract (compliance with our Terms of Service) to which you are a party (Art. 6 (1) (b) of the GDPR). Personal data is necessary to execute a contract (Terms of Service) with you. If you do not provide us with this personal data, we will not be able to enter into or perform a contract (Terms of Service) with you. We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

Additionally, if you are a seller on Annoncio and wish to receive payments from buyers via the aforementioned electronic payment system for the purchase of your products, you will need to accept ADYEN's Terms and create an electronic wallet with ADYEN (referred to on the platform as "Annoncio Balance"). To do this, you must provide the following data:

  • Full name;
  • Date of birth;
  • Billing address;
  • Social security number.

ADYEN processes this information in accordance with applicable laws and as described in ADYEN's Privacy Policy. The legal basis for collecting and using your personal data is the performance of a contract (compliance with our Terms of Service and ADYEN's Terms) to which you are a party (Art. 6 (1) (b) of the GDPR). Personal data is necessary to execute contracts (Terms of Service and ADYEN's Terms) with you. If you do not provide us with this personal data, we will not be able to enter into or perform these contracts. We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

2.5.4. To facilitate donations

When you make a donation via our platform, we collect and use the following data to enable you to make the donation:

  • Amount of the donation;
  • Date and time of the donation;
  • Name of the organization receiving the donation.

The legal basis for this collection and use is our legitimate interest in providing value to our members by allowing them to support their causes (Art. 6 (1) (f) of the GDPR). We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for 5 years.

2.5.5. To implement compliance checks (KYC) on our platform

Whenever you reach the KYC thresholds set by ADYEN, ADYEN will request a copy of your passport, identity card, or driver's license, including temporary permits. In this case, we will allow ADYEN to collect the following data from you to enable ADYEN, as a payment service provider, to perform an identity verification (known as Know Your Customer, KYC):

  • Full name;
  • Date of birth;
  • Address;
  • Social security number;
  • Email address;
  • Information present on the provided document (the exact list depends on the document provided): document number, photo, gender, nationality, date of issue, expiration date, place of birth, personal code, signature, other information on a particular document.

As an additional security measure, ADYEN may also request a photo/screenshot of the bank statement listing transactions for a period of one month. In this case, we collect the following information at ADYEN's request:

  • Full name;
  • Date of birth;
  • Country;
  • Address;
  • Information present on the provided statement: full name of the account holder, transaction history (deposits, charges, withdrawals) and other information present on a particular statement.

For this purpose, Annoncio has implemented ADYEN's API—a technical measure that allows you to submit a copy of your document and other data to ADYEN without leaving the platform. All copies of documents go directly to our payment provider ADYEN without being stored on our systems. This is necessary to meet our legitimate interest in providing ADYEN with the information needed to comply with the legal obligations to which ADYEN is subject (Art. 6 (1) (f) of the GDPR). Personal data is necessary to execute a contract (Terms of Service) with you. If you do not provide us with this personal data, we will not be able to enter into or perform a contract (Terms of Service) with you. We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

2.7. To carry out marketing activities

Annoncio wishes to engage our members in marketing campaigns that benefit them. At the same time, we want to present you with marketing material that is both relevant and engaging.

2.7.1. To send you marketing emails

You can sign up for our newsletter and other marketing emails ("Marketing Emails"). Upon signing up, we will ask for your permission to use your email address to send you Marketing Emails containing the latest information about our products and services, including regarding items available on our platform, special offers, and marketing campaigns. If, during your signup, you do not give your consent, you can change your mind at any time and agree to receive Marketing Emails by modifying your Annoncio account settings. We base this collection and use on your consent (Art. 6 (1) (a) of the GDPR). You can give or withdraw your consent at any time with future effect. In your Annoncio account, you can adjust your settings to choose which emails you want to receive or disable the receipt of future Marketing Emails. Alternatively, you can click "Unsubscribe" at the end of the Marketing Email. Withdrawing your consent will not affect the legality of the collection and use carried out prior to the withdrawal of your consent. Annoncio uses the service provider Braze, Inc. (USA), established outside the European Economic Area, to send Marketing Emails. In this case, personal data is protected by the service provider by entering into the EU standard contractual clauses for data transfer approved by the European Commission. We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years or until you withdraw your consent.

2.7.2. To personalize marketing communications

To show you more relevant marketing messages and advertisements on our platform, we may personalize them using the data provided during registration (see sections 2.1.1, 2.1.2, and 2.1.3 above), as well as data related to your Annoncio account (see section 2.2), your activity on our forum (see 2.1.10), your log files (see 2.3.1 above), and other means (see 2.7.7).

To personalize marketing messages for you, we use the service provider Braze, Inc. (USA), which is based outside the European Economic Area. In this case, personal data is protected by the service provider through the conclusion of EU standard contractual clauses for data transfers approved by the European Commission.

We may also use your personal data to display personalized Annoncio advertisements on third-party platforms such as Google, YouTube, Instagram, or Facebook. To this end, we may share your email address, phone number, IP address, and Facebook ID with Meta, Inc. (USA) and your email address with Google, Inc. (USA). In this case, personal data is protected by the third-party platforms through the implementation of EU standard contractual clauses for data transfers approved by the European Commission.

We base this collection and use on our legitimate interest in presenting you with marketing messages and advertisements that we consider relevant to you (Art. 6 (1)(f) GDPR).

We collect and use your personal data for this purpose until your Annoncio account is deactivated or for five years of inactivity on your account.

2.7.3. To contact you for advertising and/or revenue opportunities
If you register on the platform, we may contact you via email or the platform messaging system to propose sharing your content (e.g., photos) on our social media profiles, participating in our marketing campaigns, sharing your information with the press, or other advertising and/or revenue opportunities. This ensures that only members who have given consent are featured on our social media profiles or receive other advertising and/or revenue opportunities.

We base this collection and use on our legitimate interest in increasing your visibility and that of Annoncio and/or providing you with revenue opportunities (Art. 6 (1)(f) GDPR).

If you consent, we may verify your profile information to ensure we only offer advertising and/or revenue opportunities to members in good standing (i.e., in compliance with the Terms of Use). The collection and use of your personal data for this purpose will be based on your consent (Art. 6 (1)(a) GDPR).

If you agree to participate in advertising and/or revenue opportunities proposed by us, the subsequent collection and use of your personal data will be based on your consent (Art. 6 (1)(a) GDPR).

If you sign a contract with Annoncio regarding the advertising and/or revenue opportunity, the collection and use of your personal data will be based on a contract between Annoncio and you (Art. 6 (1)(b) GDPR).

We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years. Messages themselves are deleted after twelve (12) months.

2.7.4. To conduct advertising campaigns involving you
If you agree to participate in our advertising campaigns, we will use your phone number to contact you with an invitation to participate in our advertising campaign and provide more details about the project.

If you sign a contract with Annoncio regarding the advertising campaign, we will collect and use the following data to complete and fulfill a contract between you and Annoncio:

  • Full name;
  • Date of birth;
  • Nationality;
  • Information about your business certificate or individual commercial activity.

If you provide your address and room photos, we will use them to arrive at your location and film the advertisement. If you wish, we may also use your name, age, city, or story to include in the advertising campaigns.

We base your invitation to participate in our advertising campaigns on our legitimate interest in increasing your visibility and that of Annoncio (Art. 6 (1)(f) GDPR). If you agree, your participation in our advertising campaign will be based on a contract between Annoncio and you (Art. 6 (1)(b) GDPR).

This data may be transferred to our partners (advertising agencies, directors) responsible for implementing the advertising campaign.

The personal data necessary for your participation in our advertising campaign is required to fulfill a contract with you. If you do not provide this personal data, we will not be able to conclude or fulfill a contract with you.

We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

2.7.5. To feature your items in marketing campaigns
If you do not opt out, we may use data from your uploaded items (such as photos, titles, descriptions, and categories) and any other content you create on the platform to help you sell your items and/or promote Annoncio. This may include showcasing your content across various online platforms (such as banners and articles on third-party sites), social media (such as Facebook, Instagram, etc.), and other channels. You can stop our use of your content in marketing campaigns at any time by opting out in your account's privacy settings.

We base this collection and use on our legitimate interest in increasing the visibility of your items and/or Annoncio (Art. 6 (1)(f) GDPR).

To showcase your content on the mentioned channels, we share your data with relevant recipients such as advertising service providers, social media operators, etc.

This may sometimes result in a transfer of your data outside the European Economic Area. In such cases, personal data is protected by the data recipients entering into the EU standard contractual clauses for data transfer or following adequacy decisions, both approved by the European Commission.

We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for 5 years. If you opt out, we will stop using your data for this purpose as soon as you make this decision.

2.7.6. To allow you to see advertisements on the platform
To show you advertisements on our platform and allow you to participate in our marketing campaigns, we use cookies and other tracking technologies that may collect data about your activities on our website.

We base this collection and use on our legitimate interest in promoting our products and services (Art. 6 (1)(f) GDPR).

We collect and use your personal data for this purpose until your Annoncio account is deactivated or inactive for five (5) years.

2.7.7. To create audience segments and target our marketing campaigns
To maximize the effectiveness of our marketing, we use data about you to create audience segments based on your profile data, platform activities, log files, and other information (see above).
